General Terms and Conditions of Sale

These sales conditions are concluded on the one hand by LGK (brand: Flamboyante), with a share capital of €5,000, whose registered office is located at 231 rue Saint-Honoré, 75001 Paris, registered with the Paris Trade and Companies Register under number 908 031 404 R.C.S. Paris, hereinafter referred to as "LGK" and managing the site Flamboyante, https://flamboyante.shop, and on the other hand, by any natural or legal person wishing to make a purchase via the Flamboyante website, https://flamboyante.shop, hereinafter referred to as "the buyer".

 

Article 1. Purpose

These sales conditions aim to define the contractual relationship between LGK (brand: Flamboyante) and the buyer and the conditions applicable to any purchase made through the Flamboyante website, https://flamboyante.shop. The acquisition of a product through this site implies the buyer's unconditional acceptance of these sales conditions, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the Flamboyante site, https://flamboyante.shop, is not directly related to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity to commit to these general sales conditions.

LGK reserves the right to modify these sales conditions at any time to comply with new regulations or to improve the use of its site. Consequently, the applicable conditions will be those in effect on the date of the buyer’s order.

These Terms and Conditions are available at any time on the site https://flamboyante.shop and will take precedence over any other document.

Unless proven otherwise, the data recorded in LGK's computer system constitutes proof of all transactions concluded with the buyer.

 

Article 2. Products

The products in stock are those listed on the Flamboyante website, https://flamboyante.shop, operated by LGK, subject to availability. Preorder products can be ordered during the preorder period mentioned on the site and within the limits of the quantities offered. LGK reserves the right to modify the product range at any time. Each product is presented on the website with a description highlighting its main technical characteristics (specifications, illustration(s), material information). The photographs are as accurate as possible but do not bind LGK in any way. The color may vary depending on your computer, phone, or tablet screen and its settings.

 

Article 3. Prices

The prices are listed on the product pages of the online catalog and are in Euros (€), including all taxes (VAT) applicable on the day of the order. Any change in the VAT rate may be reflected in the product prices. LGK reserves the right to modify its prices at any time, with the understanding that the price listed in the catalog at the time of the order or preorder will be the only one applicable to the buyer. These prices are guaranteed except in the case of typographical or printing errors. Delivery charges are free for the following countries, provided the buyer does not choose their own carrier:

(hereinafter referred to as the "Delivery Zone").

The full price must be paid at the time of the Order or Preorder. At no time can the amounts paid be considered as deposits or down payments.

 

Article 4. Order and Payment Terms

The buyer selects the products they wish to order in the "cart," specifying the clothing size and adjusting quantities, references, or sizes if necessary.

The buyer must then enter their email address if no account has been created yet, or click on "log in" to access their customer account.

The next step offers the opportunity to verify or enter delivery details.

The shipping method is then displayed. Delivery times after the order has been shipped are 2 to 4 working days for France and 3 to 10 working days for other destinations within the European Union.

The order is shipped once preorders and the minimum 1-month production time for preorder products are completed.

An email will be sent to the buyer once the order has been dispatched.

The next step involves payment by credit card: the buyer enters their card number, expiration date, security code, and the name on the card.

If the buyer wishes the invoice to be sent to a different address, they simply need to uncheck the box "use shipping address as billing address" and provide the correct billing address.

Finally, the buyer can review the total amount of their order in the summary and click on "confirm order" if everything is correct. If the payment is accepted, the order is recorded, and the contract is definitively formed.

The price is payable in full by the buyer on the day of the order.

Payments made by the buyer will only be considered final after LGK has effectively received the due amounts.

Order confirmation implies acceptance of these sales terms, acknowledgment of having read them fully, and waiver of any claims based on the buyer's own purchase conditions. All provided data and the recorded confirmation will serve as proof of the transaction.

LGK reserves the right to cancel or refuse any order from a buyer with whom there is a dispute related to the payment of a previous order or if the delivery location is not within the delivery zone.

LGK will not be obliged to deliver the products ordered by the buyer if the buyer does not pay the full price or if the general sales conditions are not respected by the buyer.

If an order is returned to the sender (RTO) due to certain circumstances, the associated delivery fees will not be refunded. These circumstances include, but are not limited to:

  • Customs documents not provided: The order is returned to the sender because you did not provide the required customs documents upon request and within a reasonable timeframe.
  • Refusal to pay customs duties: The order is returned to the sender because you refused to pay the applicable customs duties.
  • Unreachable customer: The order is returned to the sender because delivery attempts failed and you were unreachable.
  • Incorrect or undeliverable address: The order is returned to the sender due to an address inconsistency or because the address provided at the time of the order was undeliverable or incorrect.

 

Article 5. Retention of Title

LGK retains full ownership of the products sold until full payment of the price, including principal, shipping costs, and taxes, has been received.

 

Article 6. Right of Withdrawal

Under Article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for a refund without penalty.

The items must be in their original packaging, new, unused, unwashed, undamaged, and with intact and attached labels. Items that are in poor condition will not be eligible for a refund. Flamboyante reserves the right to refuse any return or refund that does not meet these conditions.

Returns are free within mainland France, and at the buyer’s expense for other countries, including any customs fees or other potential taxes.

We will process your refund upon receipt of your package. You will receive an email notifying you of the refund. The refund will be made using the same payment method as that used for the purchase and will appear in your bank account within 14 working days.

We do not process exchanges: to receive a different size, you need to place a new order on the e-shop.

To receive a prepaid return label (only for mainland France), send us an email at contact@flamboyante.shop specifying your order number, the email address used to place the order, and the reason for your return, as well as the name/first name and postal address for the return if different from the order (e.g., in the case of a gift). You should keep the proof of return with the date and the carrier’s signature.

Affix the prepaid return label to your package and go to the post office or a postal contact point of your choice, or use your standardized mailbox if you arranged the return on the La Poste website. Buyers outside France are responsible for choosing their own carrier for returns (or a French buyer who wishes to choose their own carrier). Return shipping costs are the responsibility of the buyer and will not be reimbursed, as well as any customs fees or other potential taxes. Any proof of return must be kept by the buyer, which implies that items should be returned by registered mail or other means providing a certain date for the shipment. Article 7. Delivery

Deliveries are made to the address provided by the buyer, which must be within the agreed delivery zone (see "Article 3. Prices").

Delivery costs are free, unless the buyer chooses to use their own carrier.

Orders are shipped via La Poste using COLISSIMO or CHRONOPOST, with tracking and signature upon delivery.

For COLISSIMO deliveries:

The buyer will be delivered to their home by their mail carrier once the delivery notice is signed. If the buyer is not present, the package will be delivered the next day. If the buyer is still not present, they will receive a delivery notice allowing them to collect the ordered products from the nearest post office within a timeframe indicated by the postal services (usually 15 days from the date on the delivery notice). With the tracking number available on the delivery notice, the buyer can reschedule their delivery if this option has been provided. It is also possible to request to pick up the package directly at the nearest post office.

For CHRONOPOST deliveries:

With Predict, you can change the delivery date according to your availability. Predict allows you to reschedule the delivery and have it delivered to your home on another date, to a neighbor, to a secure location, or to a nearby pickup point. To reschedule and change the date or delivery location:

  • Go to the tracking page of your package or ask the chatbot Léonard directly to "Give an instruction".
  • The available options will then be proposed to you.
  • If rescheduling options are not available on the package tracking page, it is likely that the package is not eligible for this service.
  • In the case of absence during delivery, a delivery notice will be left in your mailbox.

Note: For deliveries with a secure code, options for delivery to a secure location or to a neighbor cannot be requested.

 

After the order has been shipped, delivery times are 2 to 4 working days for France and 3 to 10 working days for EU member countries within the delivery zone. Delivery times are indicative only.

The order is shipped once preorders and the minimum 1-month production time for preorder products are completed.

The buyer will receive an email once the order has been shipped with the tracking number of their package.

The risks related to transportation are the responsibility of the buyer once the items have been received by the buyer. The buyer is required to check, in the presence of the La Poste employee or the delivery person, the condition of the package and its contents upon delivery. In case of damage during transport, any complaint must be made to the carrier within three days of delivery, and the buyer must also inform LGK by email at contact@flamboyante.shop.

 

Article 8. Warranty

All products provided by LGK benefit from the legal warranty as stipulated by Articles 1641 and following of the French Civil Code. In the event of a product not conforming to the contract, it can be returned to LGK, who will either replace it or provide a refund. All claims or refund requests must be made by email to contact@flamboyante.shop, and the package must be returned within fifteen days after delivery.

 

Article 9. Liability

In the context of distance selling, LGK is only bound by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service disruption, or other unintended problems.

Article 11. Website

The site is freely accessible to any user with an internet connection. The equipment (computer, phone, software, or other telecommunications means) required to access the site is the sole responsibility of the user, as are any telecommunications costs incurred by their use. The user is solely responsible for the proper functioning of their computer equipment and their internet access.

The site is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond the company’s control, and subject to potential outages and maintenance interventions necessary for the proper functioning of the site. Maintenance interventions may be carried out without prior notice to users.

It is the user’s responsibility to take any appropriate measures they deem necessary to protect their own data and/or software and/or hardware from the risk of contamination by potential viruses or other computer infections circulating on the internet. LGK cannot be held responsible for any potential contamination.

Certain personalized services on the site use temporary cookies for their proper functioning. The user can disable or delete cookies using their browser options. As each browser is different, the user is encouraged to consult their browser’s documentation to configure it as needed.

Article 12. Intellectual Property

All elements of the Flamboyante site, https://flamboyante.shop, are and remain the intellectual and exclusive property of LGK. No one is authorized to reproduce, exploit, or use, in any form, even partially, any elements of the site, whether in the form of photos, logos, visuals, or text. This also applies to the physical products sold on the Flamboyante website, https://flamboyante.shop.

 

Article 13. Personal Data

LGK is committed to preserving the confidentiality of the information provided by the buyer, which they may transmit for the use of certain services. By using the Site, the buyer agrees that their data will be used in accordance with our Privacy Policy and guarantees that all data provided is accurate. All information concerning the buyer is subject to the provisions of the French Data Protection Act No. 78-17 of January 6, 1978, as amended. In this regard, the user has the right to access, modify, and delete their information. Article 14. Dispute Resolution

These distance selling terms and conditions are governed by French law. For any disputes or litigation, the competent court will be the Paris Court. You also have the option to use a mediator or the European Online Dispute Resolution (ODR) platform.
